4. Your messages to be written on Postcards

Visitors may post messages to be written on real paper made postcards by HWPostcards.com, and sent to postal addresses they required. They can do so so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a postcard or other content. HWPostcards.com reserves the right (but not the obligation) to not send such content. HWPostcards.com takes no responsibility and assumes no liability for any content posted by you or any third party.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify HWPostcards.com for all claims resulting from content you supply. HWPostcards.com takes no responsibility and assumes no liability for any content posted by you or any third party.

HWPostcards.com require you to use a language among English, French, German, Italian, Portuguese, Romanian and Spanish in order to ensure that the content you provide respects the Conditions of Use. For any another language please contact us first, before ordering a postcard else the postcard will not be sent.

5. Postcards sent

HWPostcards.com attempt to be as accurate as possible. However, HWPostcards.com does not warrant that postcards descriptions or other content of this site, especially photographs, is accurate, complete, reliable, current, or error-free. The real postcards sent are chosen among the Postcards sold on Montreal retailers according to their availability and qualities.

6. Postcards received

A Postcard's content and its recipient are under the sender's responsibility. Although HWPostcards.com reserves the right (but not the obligation) to not send such content, HWPostcards.com takes no responsibility and assumes no liability for any content sent to you.

7. Pricing

Except where noted otherwise, the prices displayed on our website represent the full retail price on the service we deliver.

8. Risk of loss

All items purchased from HWPostcards.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

9. Disclaimer of warranties and limitation of liability

This site is provided by HWPostcards.com on an "as is" and "as available" basis. HWPostcards.com makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. Any dispute relating in any way to your visit to HWPostcards.com or to products you purchase through HWPostcards.com shall be submitted to arbitration in Montreal, Canada, except that, to the extent you have in any manner violated or threatened to violate any HWPostcards.com's rights, HWPostcards.com may seek injunctive or other appropriate relief in any court in Montreal, Canada, and you consent to exclusive jurisdiction and venue in such courts.

12. Terms and Conditions for Payments

Payments on HWPostcards.com are required to be done via Paypal service: HWPostcards.com disclaims all warranties regarding this service. Please check the Conditions of use of this service on http://www.paypal.com/

If you believe that any payment transaction initiated by HWPostcards.com (or its agent) with respect to your Paypalaccount is erroneous, or if you need more information about any such transaction, you should contact us as soon as possible by e-mail or electronic form provided in the "Contact Us" section of our website.

If you do not inform us within 90 calendar days after any erroneous transaction is posted to your Paypal account statement, you may not get back any money you lost after the 90 calendar days.

13. Agreement Changes

We may in our discretion change these Terms and Conditions, HWPostcards.com's Conditions of Use at any time without notice to you. If any change is found to be invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any other changes or the remainder of these Terms and Conditions. We reserve the right to subcontract any of our rights or obligations under these Terms and Conditions.
